General term and conditions of sale

1. Object

1.1 These General Conditions of Sale (the “General Conditions”) govern the supply and/or sale of products and services, including subscriptions (the “Products”), carried out remotely via telephone and paper communications, as well as through the telematic network via the website http://www.shoped.it (the “Site”) and all related sites, particularly the magazines “Quattroruote” (https://www.quattroruote.it), “Ruoteclassiche” (https://ruoteclassiche.quattroruote.it), “Domus” (https://www.domusweb.it), “Meridiani” (https://www.montagna.tv), “Cucchiaio d’Argento” (https://www.cucchiaio.it), “Dueruote” (https://www.dueruote.it), “X Off Road” (https://xoffroad.dueruote.it) (hereinafter collectively referred to as the “Magazines”), exclusively owned by Editoriale Domus S.p.A. with registered office at via Gianni Mazzocchi 1/3, 20089 Rozzano (Milano) .

1.2 These General Terms and Conditions also regulate the supply and/or sale of Products in the Editoriale Domus applications present on the Google and Apple stores

1.3 The Products regulated by these General Conditions are reserved for direct user Customers, strictly excluding entities such as traders, wholesalers, resellers, professionals, etc., who intend to resell the Products to third parties. Each purchase operation will be governed by the provisions of Chapter I of Title III of Part III of Legislative Decree no. 206 of September 6, 2005, and subsequent amendments and integrations, known as the Consumer Code, and, as regards the protection of personal data, by those of Regulation (EU) 2016/679.

2. Acceptance of the General Conditions

2.1 The customer (the “Customer”), by purchasing one of the Products, unconditionally accepts and undertakes to observe these General Conditions in their relations with Editoriale Domus S.p.A. They declare that they have read and accepted all the provisions contained herein, also acknowledging that Editoriale Domus cannot be bound by different conditions unless previously agreed in writing.

2.2 These General Conditions must be read carefully and accepted by the Customer before confirming the purchase of one of the Products. Such confirmation, therefore, implies full knowledge and complete acceptance of them.

3. Types of Products for Sale

3.1 The Products offered for sale by Editoriale Domus through the Site may be (i) physical editorial products (such as books and booklets), (ii) print subscriptions to the physical Magazines published by Editoriale Domus, (iii) digital Products (for example, the digital edition of the Magazines and the Quattroruote quotation service), (iv) in-depth editorial content (paper and non-paper), also related to one of the Magazines and/or Products.

3.2 Among the above Products, the Customer can activate subscription services that allow access to additional editorial content compared to those made available to the public through the Site and the Quattroruote Magazine (the “Q Premium Offer”). The details regarding costs, duration, content, and delivery methods of the Q Premium Offer are those indicated on the specific page of the Site and sent following the purchase of the Q Premium Offer to the email provided by the Customer at the time of registration as provided in the Terms and Conditions of use of the Quattroruote Site, to which full and integral reference is made.

3.3 Editoriale Domus reserves the right to modify the offer of Products at its sole discretion and without being bound by any notice period.

4. Purchase of Products

4.1 The purchase of one of the Products, available as illustrated and described in the materials and pages of the Site and/or the sites made available to the Customer, is made by the Customer within the Site at the price indicated therein, including transport costs, if applicable. Before completing the purchase, the Customer knows the unit cost of each selected Product, as well as, in the case of purchasing multiple Products, the total cost.

4.2 Once the purchase is confirmed and a valid email address is provided, the Customer will receive an email containing the number, date, and total amount of their order.

5. Purchase of Physical Editorial Products

5.1 The Customer can purchase paper editorial Products through the methods that will be allowed by Editoriale Domus from time to time, including:

a) calling from Italy at the number 02.56568800 from Monday to Friday, from 9.00 to 18.00 and from abroad at the number 02.82472529 (Monday – Friday 9.00-13.00, 14.00-17.00). Call costs will depend on the operator and the tariff plan;

b) writing an email to uf.vendite@edidomus.it with the details of the Product they intend to purchase;

c) connecting to the Site www.shoped.it and, after registering, opting for the chosen Product.

6. Methods of Purchasing Print or Digital Subscriptions

6.1 The Customer can purchase a print subscription to and/or digital edition through the methods that will be allowed by Editoriale Domus from time to time, including:

a) calling from Italy at the number 02.56568800 from Monday to Friday, from 9.00 to 18.00 and from abroad at the number 02.82472529 (Monday – Friday 9.00-13.00, 14.00-17.00). Call costs will depend on the operator and the tariff plan;

b) writing an email to uf.abbonamenti@edidomus.it with the details of the Product they intend to purchase;

c) connecting to the Site www.shoped.it and, after registering, opting for the chosen Product.

7. Methods and Terms of Payment 

7.1 Editoriale Domus provides the following payment methods for the purchase of physical or digital editorial Products and/or other types made from Italy or abroad:

a) Credit card. Editoriale Domus cannot be held responsible for any fraudulent and illegal use that may be made by third parties of credit cards at the time of payment for the purchased products. At no time during the purchase procedure is Editoriale Domus able to know the buyer’s credit card number, which is collected through a secure connection directly by the company Stripe or PayPal, the service managers.

b) Payment to postal current account no. 55953202 (for subscriptions) and no. 668202 (for other editorial Products), in the name of Editoriale Domus S.p.A. via Gianni Mazzocchi 1/3 20089 Rozzano (MI). Payment method valid only for Italy and not applicable to digital products.

c) Bank transfer. To be made in favor of Editoriale Domus Spa, Via Gianni Mazzocchi 1/3 20089 Rozzano (Milano) Unicredit, Filiale Milano Metropolitana – Via Marco D’Aviano 5 20131 Milano, IBAN IT77X0200805364000104272924 SWIFT UNCRITMMORR. The reason for payment must include the name of the product and the recipient of the purchase. Payment method not applicable to digital products.

d) Cash on delivery. Payment can only be made in cash (bank or cashier’s checks are not accepted) directly upon delivery. Payment method not applicable to digital products and subscription products. Payment method valid only for Italy

e) PayPal. It is an online payment system that requires opening a PayPal account. By choosing this payment method, the amount is charged directly to the PayPal account at the time of order acquisition. Editoriale Domus cannot be held responsible for any fraudulent and illegal use that may be made by third parties of the PayPal account at the time of payment for the purchased products. Editoriale Domus is in no way connected to PayPal nor can it be traced back to it. For payments made through PayPal, refer to the service’s terms of use available at the following link.

7.2 The specific payment methods for each of the Products will be expressly indicated in the Editoriale Domus communication material or published within the Sites. The choice among the available methods will be made by the Customer.

8. Availability of Products 

8.1 Paper Products for Sale

The delivery of paper Products such as books, issues of Magazines or binders will be made within a week of the order, unless otherwise explicitly provided, which will apply, for example, to pre-ordered works, whose delivery will be made from the date communicated by Editoriale Domus. The purchased Products will be delivered to the address indicated by the Customer at the time of registration on the Site or confirmation of the purchase. Based on the indicated address, the Customer may be asked to contribute to shipping costs. In the case of Products purchased cash on delivery, the Customer will be asked to contribute to the cash on delivery service. Product deliveries will be made on all working days (Monday to Friday). In the case of purchasing multiple works, delivery may be split, without any liability for Editoriale Domus. For the delivery of Products, Editoriale Domus uses the service offered by couriers. The Customer is required to verify, upon receipt, the conformity of the delivered Product based on the following indications:

  • The number of packages indicated in the carrier’s letter must correspond to the number of packages actually delivered;
  • The package must be intact, not damaged or wet. Only after these checks can the Customer sign the delivery note. After signing, the Customer cannot raise any objections regarding the external characteristics of what was delivered to them in relation to the order placed. If there is no correspondence between the order and the delivery, according to the aforementioned methods, the Customer must not accept the goods and raise the objection directly with the carrier. If the delivered Products do not correspond to the order, the Customer can agree on the methods of replacing the Products by:
  • calling Customer Service from Italy at the number 02.56568800 (Monday-Friday 9.00 – 18.00) and from abroad at the number 02.82472529 (Monday – Friday 9.00-13.00, 14.00-17.00); call costs depend on the operator and the Customer’s tariff plan, or,
  • sending an email to uf.vendite@edidomus.it if from Italy or to sales@edidomus.it if from abroad. It is understood that Editoriale Domus is in no way responsible for delays in the delivery of Products and/or Magazines due to acts and/or faults of third parties and, as such, beyond its control.

8.2 Print Subscription Products

For the delivery of print subscription Products, in the case of monthly Magazines, the first copy will be delivered within 5 weeks of the order, and in the case of bimonthly Magazines, the first copy will be delivered within 10 weeks of the order (the delivery times indicated are only valid for Italy). Based on the indicated address, the Customer will be asked to contribute to shipping costs. If a copy arrives damaged or is not delivered, the Customer can request a reshipment by:

  • contacting the Subscription Service: for Italy at the number 02.56568800 (Monday-Friday 9.00 – 18.00) and for abroad at the number 02.82472529 (Monday-Friday 9.00-13.00, 14.00-17.00).
  • sending an email to uf.abbonamenti@edidomus.it for Products purchased from Italy or to subscriptions@edidomus.it for Products purchased from abroad. It is understood that Editoriale Domus is in no way responsible for delays in the delivery of copies of subscription Products due to acts and/or faults of third parties and, as such, beyond its control. Only if expressly specified, following the purchase of a print Magazine subscription, the Customer can also consult the digital edition of the same Magazine. The consultation of the digital edition included in the print subscription will have the same start and duration as the subscribed print subscription. The Customer can access the digital edition by following the instructions received via email at the end of the purchase procedure.

8.3 Availability of Digital Products

Following the purchase of a subscription to a digital Product, the Customer is enabled to consult the Product immediately after the order payment, from which point the service is considered provided. The Customer can access the Products through the dedicated page on the Site, via a link that will allow online consultation.

9. Subscription Duration and Renewal 

9.1 The duration of the subscription to the Products is the one chosen by the Customer from the available options at the time of subscription.

9.2 The subscription to the Products will end at the term provided by the individual subscribed offer. If the Customer has opted for automatic renewal of the subscription, they can deactivate the renewal at any time before 11:59 p.m. on the expiration day by clicking on the “Disable recurring payment” button within their account in the subscription section. If the Customer decides to deactivate the subscription, still have access to the Products until the end of the already paid period.

9.3 In the case of automatic renewal, Editoriale Domus will charge the price using the same payment method previously used by the Customer.

9.4 It is understood that Editoriale Domus will inform the Customer in advance of any price or content changes to the Products.

10. Right of Withdrawal 

10.1 The right of withdrawal applies to all Products with the strict exclusion of digital ones. In fact, to avoid copyright and copy violations, the purchase of such Products is subject to the prior express waiver of the right of withdrawal, as provided by Article 59, paragraph 1, letter (o), of the Consumer Code. Without this consent, Editoriale Domus cannot provide such products.

10.2 Pursuant to and within the limits of the aforementioned Consumer Code, the Customer has the right, within 14 days of receiving the requested Products, to exercise the right of withdrawal by means of a specific withdrawal communication, also using the form available at this link.

10.3 The withdrawal communication must be signed by the Customer and sent by registered letter with acknowledgment of receipt within the prescribed period. It can also be sent, within the same period, by email to uf.vendite@edidomus.it provided that it is confirmed by registered letter with acknowledgment of receipt sent within forty-eight hours to the address:

10.4 Within 14 days from the date of receipt of the withdrawal communication, Editoriale Domus will inform the Customer, by email to the address indicated by the Customer in the above communications, of the “lettera di vettura” (waybill), so that it can be affixed to the goods to facilitate their return operations. The Customer must return the goods within 14 days from the date of receipt of the waybill. Editoriale Domus will then proceed with the transmission of the credit order relating to the cost of the shipped goods and the initial shipping costs within 14 days following the receipt of the Products returned by the Customer. The refund will be made using the same payment method used by the Customer for the initial transaction, except in cases where the Customer paid for the goods by cash on delivery; in this case, the refund operation will be carried out by crediting the current account indicated by the Customer. The Customer is required to return the Products in the state in which they were delivered and perfectly packaged. The costs of returning the Products to Editoriale Domus will be borne by the Customer. Editoriale Domus will reject any Product if the return costs have not been fully paid by the Customer; or if the methods and times provided by the Consumer Code for the communication of the exercise of the withdrawal have not been respected, or if the product has not been packaged with original packaging, or is not complete with all accessories, instruction manuals, and everything originally contained.

10.5 It is understood that in the case of exercising the right of withdrawal from the Q Premium Offer, which provides for the supply of both digital and paper Products, this will only apply to paper Products. Editoriale Domus will refund the Customer the amount corresponding to the value of the unused copies. Nevertheless, the Customer can continue to consult the digital Products until 23:59 on the expiration day of the subscribed Subscription Offer.

11. Interruptions and suspensions of Subscription Products 

11.1 Editoriale Domus is expressly exempt from any compensation claims arising from the interruption and/or suspension of sales and/or subscription services for reasons not directly attributable to it.

11.2 In any case, Editoriale Domus has the right to interrupt and suspend the sales and/or subscription service governed by these General Conditions at its sole discretion without this generating any liability towards it. In this regard, an exception will be made for any refund of the price paid for unused paper Products.

12. Prices and Taxes 

12.1 All prices of Products for sale and subscription include VAT.

13. Magazine Apps Available on Apple and Google Stores 

13.1 Editoriale Domus provides Customers with the possibility to consult the Magazines, or additional content, through applications downloadable from the Apple and Google stores (the “Apps”).

13.2 Any purchases on the Apple and Google shops are made through the respective payment systems. In this regard, refer to the general conditions provided for the individual Apple platforms at this link and Google at this link.

13.3 Editoriale Domus cannot be held responsible for any changes to the general conditions affecting the Apple and Google stores. The Customer is therefore required to Magazinely consult the aforementioned general conditions to stay updated on any changes and/or additions.

14. ShopED Site Security 

14.1 The ShopED Site and related sites are made available in collaboration with Stripe and PayPal. During the purchase process, addresses related to sites belonging to the stripe.com domain may appear. All communications between the Customer’s browser and the servers are encrypted using the SSL (Secure Socket Layer) security protocol. In this way, all data, particularly the credit card number, are made unreadable during all purchase phases, ensuring secure and confidential communication. At the end of the purchase, the customer will receive an email confirming all operations related to the transaction made.

15. Copyright 

15.1 The Customer expressly acknowledges that Editoriale Domus is the exclusive owner of all intellectual and industrial property rights on the Site, the Magazines, and their trademarks, as well as on any content present on the Site or in the Magazine Apps or on any sites linked to the Magazines, including their pages on Social Networks, such as, by way of example and not limited to, texts, images, videos, plans, maps, photographs, stories, audio, know-how, source code, software, hardware, projects, applications, trade secrets, formulas, algorithms, models, databases, and similar (the “Contents”).

15.2 The Customer agrees that the reproduction of the Contents or parts of them for purposes other than simple private use is expressly prohibited. No Content or part of it may be reproduced or transmitted in any form or by any means, whether electronic, mechanical, photographic, or otherwise, without the prior consent of Editoriale Domus. Under these General Conditions, any form of economic exploitation of the purchased Products, including subscriptions, and/or their contents, in whole or in part, is therefore prohibited by the Customer, including, by way of example: storing or saving the Contents and/or Products to allow access to third parties, creating summaries, extracts, or other derivative works, removing the copyright or trademark from the Products and/or Magazines from their contents.

15.3 Any reproduction – even partial and even if carried out through techniques such as mirroring, framing, posting, or by any other means – without the written authorization of Editoriale Domus is also prohibited.

16. Jurisdiction and Competent Court 

16.1 These General Conditions are governed by Italian law and, in particular, with exclusive reference to the Customer who can qualify as a consumer, by the rules of Chapter I of Title III of Part III of the Consumer Code.

16.2 Any dispute that may arise between Editoriale Domus and the Customer regarding the validity, interpretation, or execution of these General Conditions will be subject to Italian jurisdiction.

16.3 Except as provided by Article 66-bis of the Consumer Code and in any case where the Customer cannot qualify as a consumer, the Foro di Milano will have exclusive jurisdiction for the resolution of disputes arising between the Parties.

16.4 For the out-of-court resolution of disputes arising in relation to consumer contracts governed by the provisions of Sections I to IV of Chapter I of Title III of Part III of the Consumer Code and related to these General Conditions, the Customer may resort to mediation procedures pursuant to Legislative Decree no. 28/2010, or may resort to ADR (Alternative Dispute Resolution) bodies through the ODR (Online Dispute Resolution) platform, established and managed by the European Commission, accessible via this link.

17. Personal Data Processing 

17.1 Pursuant to and for the purposes of Article 13 GDPR, Editoriale Domus makes available to Customers, in their capacity as data subjects, the information on the processing of personal data at the following link, to which full and integral reference is made and which has been previously viewed and accepted by the Customer at the time of accessing the Site.
